TIP 24B05-04 Sales and Reporting of Dyed Diesel Fuel During Penalty Relief Period
In response to Hurricane Milton, the Internal Revenue Service (IRS) has announced that it will not impose a penalty when dyed diesel fuel is sold for use or used on the highway. This penalty relief period began October 9, 2024, and will continue through October 30, 2024.

State of Florida Notice of Emergency Rule: Volatility Standards for Gasoline
​
Interstate lane closures and operations on active construction projects within the projected path of the storm have been suspended. Contractors on these construction projects are currently securing work sites, clearing traffic control devices that are not actively being used to direct traffic, and checking drainage systems. Emergency Shoulder Use has been activated along portions of I75 and I4. Please pay close attention if you have trucks traveling in the area:

Governor Ron DeSantis issued Executive Order (EO) 24-212 and Executive Order (EO) 24-213. Governor DeSantis also directed the Department of Business and Professional Regulation (DBPR) to issue Order 2024-09. Executive Order 24-213 issues directives to the Florida National Guard, Florid State Guard, Department of Transportation, and the Florida Department of Highway Safety and Motor Vehicles to take certain actions to mitigate potential disruptions caused by ongoing port strikes to the supply chain and those recovering from Hurricane Helene.

Effective immediately, emergency response vehicles such as, but not limited to, utility vehicles, bucket trucks, and supply trucks responding to Executive Order 24-208 (Emergency Management - Tropical Cyclone Nine), are given authorization to bypass all FDOT weigh station facilities through October 7, 2024.
This authorization does not include vehicles that require permits to operate on Florida's roadways. This authorization does not relieve size and weight restrictions.
Additionally, EOC has requested that we contact the following states to assist in bypass efforts for utility trucks coming to assist from Ohio and Indiana:
• Georgia, Tennessee, Alabama, South Carolina, and North Carolina

Executive Order Number 24-208 (Emergency Management – Potential Tropical Cyclone Nine)
which provides relief to commercial motor vehicles transporting emergency supplies, equipment or personnel for relief efforts, effective today, September 23 and expiring October 7, 2024. In addition to relieving hours of service requirements in 49 CFR 395.3 and 395.5, the emergency order also waives replacement fees and defers administrative actions related to the issuance/replacement of credentials (e.g. identification cards, driver licenses or vehicle or vessel registrations or titles) based upon inclement weather or office closures.
FDOT Secretary Jared Perdue has authorized FDOT Emergency Order 24-08 which will result in FDOT issuing an Emergency Road Use Permit and Agriculture Designations.

Updates to the enforcement bulletin related to EO 156,157,158- Changes in commodities
​The following commodities are no longer part of the bulletin: Aquaculture Products, Fuel, Fertilizer and Agrichemicals, Milk and Milk Products, Silviculture and Forestry Products, and Sod have been removed from the Commissioner of Agriculture. This bulletin expires August 23, 2024.
FLHSMV EO suspending enforcement of registration requirements under sections 316.545(4) and 320.0715, Florida Statutes, for commercial motor vehicle that enter Florida to provide emergency services or supplies, to transport emergency equipment, supplies or personnel, or to transport FEMBA mobile homes or office style mobile homes into or from Florida. This Emergency Order does not extend regulatory relief from the Federal Motor Carrier Safety Regulations as HSMV Emergency Order 24-03 provided. Valid through August 30, 2024.

The IRS will not impose penalties for failure to make semimonthly deposits of tax for dyed diesel fuel sold for use or used in an emergency vehicle on the highway in the state of Florida during the relief period. IRS Publication 510, Excise Taxes, has information on the proper method for reporting and paying the tax.
